The terms governing use of the iden platform and the iden.software website. A separate Master Services Agreement applies to each commercial customer.
These terms ("Terms") govern use of the website iden.software and the public-facing aspects of the iden platform operated by Flexcon EOOD.
Commercial use of iden (by venue operators who contract with Flexcon to deploy the platform for their own businesses) is governed by a separate Master Services Agreement and accompanying Data Processing Agreement signed between Flexcon and each customer. Where those signed documents and these Terms conflict, the signed documents prevail.
Flexcon EOOD is a Bulgarian limited liability company registered with UIC 205202354, VAT registered under BG205202354, with its registered office at Sofia, 47A Cherni vrah Blvd., floor 4, Bulgaria. Managing Director: François Dehaibe.
iden is a modular customer experience platform for physical venues, comprising modules including iden.pass, iden.perks, iden.reach, iden.pulse, iden.core, iden.connect, iden.book, iden.pos, iden.ops, and the iden.crew staff application. Module availability and commercial terms are defined in each customer's commercial agreement.
Flexcon may modify, improve or discontinue any feature at any time, provided that any material change affecting commercial customers will be communicated in advance and handled in line with the customer's commercial agreement.

The iden platform, the iden.software website, all associated source code, designs, documentation, trademarks, and brand assets are the exclusive intellectual property of Flexcon EOOD or its licensors. No rights are granted by these Terms other than the limited right to use the service in line with the applicable commercial agreement.
The iden word mark and associated visual identity are used under the control of Flexcon EOOD.
For commercial customers, personal data processed through iden belongs to the customer, who acts as the data controller. Flexcon acts as a data processor and processes such data strictly in accordance with the Data Processing Agreement, these Terms, and applicable law. A customer can export their data at any time and will receive it back on contract termination in line with the Master Services Agreement.
Where a customer uses iden.pos for fiscal operations in Bulgaria, Flexcon acts as a registered СУПТО software manufacturer under NRA Ordinance H-18. The designated guarantor is François Dehaibe. The customer remains responsible for operating the software in accordance with applicable Bulgarian fiscal law, including proper fiscal-device registration with the NRA and day-to-day operational compliance.
The website and any materials accessed through it are provided on an "as is" basis. To the fullest extent permitted by applicable law, Flexcon disclaims all warranties with respect to the public website, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Commercial customers receive specific contractual warranties set out in their Master Services Agreement.
To the fullest extent permitted by applicable Bulgarian law, Flexcon will not be liable for any indirect, incidental, consequential, special or punitive damages arising out of or related to use of the iden.software public website. For commercial customers, liability is governed by the Master Services Agreement.
Nothing in these Terms limits any liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for willful misconduct.
Flexcon may update these Terms from time to time. The "Last updated" date at the top of this page shows the most recent revision. Continued use of the website after a change constitutes acceptance of the updated Terms. For commercial customers, changes to the Master Services Agreement follow the notice and amendment procedure set out in that agreement.
These Terms are governed by the laws of the Republic of Bulgaria. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Sofia, Bulgaria, without prejudice to any mandatory consumer-protection rights under applicable law.
